第三条 保证条款：
3.1 乙方推荐的候选人到甲方公司工作的__3__个月内，由于乙方所推荐候选人的自行离职，或因其不能胜任甲方工作，被甲方解约的，甲方应在7个工作日内联系乙方，由乙方继续为甲方推荐合适人选，直到成功。如甲方不需要乙方再作介绍的,乙方应退回甲方中介费用50%。
第四条 支付、退款和付款方式：
4.1 乙方推荐的人员被甲方录用后，乙方按以下标准向甲方收取人才中介费；

4.4 若遇到本合同中第三款“保证条款 3.1”中所述原因，导致被录用者离职，并且甲方也不再需要乙方继续为其推荐适合的人选，乙方将返还甲方50％人才中介费。
4.5 付款方式：付款方式以银行转账为主。
第五条 保密条款：
5.1 甲方必须对所签订合同严格保密，而乙方亦不得将甲方的文件或信息泄露出去。
第六条 合同的解除
6.1 甲方在提前10个工作日向乙方发出书面通知并得到乙方同意的，可以解除本合同或附属合同。解除本合同或附属合同后，乙方已收的费用不予返还（本合同第三条第一款规定的情况除外），已发生的费用甲方要继续履行支付责任。
第七条 争议的解决
7.1 甲乙双方之间因本合同的解释、履行等发生争议的，由甲乙双方通过友好协商加以解决。通过协商无法解决争议的，任何一方均可就该争议申请仲裁或通过法律途径解决。
第八条 未尽事宜
8.1 有关本合同的未尽事宜，由甲乙双方另行协商决定。
第九条 合同的生效
9.1 本合同自各方加盖各方公章或合同章之日起生效。
9.2 本合同一式两份，由甲乙双方各持1份。
