7. Recipient acknowledges that a breach of its obligations above will cause irreparable harm to Provider. Accordingly, Recipient agrees that the remedy at law for a breach of its obligations above may be inadequate and agrees that in the event of a breach or threatened breach by Recipient of the provisions of this Agreement, Provider shall be entitled, in addition to all other remedies at law or equity, to an injunction restraining any breach and requiring immediate transfer to Provider or destruction of any and all Confidential Information in Recipient’s possession.
8. In any action brought to enforce, or for breach of, this Agreement, the prevailing party shall be entitled to an award of all of its reasonable attorneys’ fees and costs, in addition to any other monetary relief awarded by the court.
